The image is used for visual identification and illustration of a subject of public interest. The significance of the photograph of the doll is to illustrate the visual appearance and style of the doll in an article containing critical commentary about the dolls, in a way that words alone could not convey.
Because the design of the dolls is protected by copyright, there is almost certainly no free equivalent. Any equivalent alternatives would also be derivative works. Any substitute that is not a derivative work would fail to convey the meaning intended, would tarnish or misrepresent its image, or would fail its purpose of identification or commentary.
This is a two-dimensional representation of a copyrighted sculpture, statue or any other three-dimensional work of art. As such it is a derivative work of art, and per US Copyright Act of 1976, § 106(2) whoever holds copyright of the original has the exclusive right to authorize derivative works.
Per § 107 it is believed that reproduction for criticism, comment, teaching and scholarship constitutes fair use and does not infringe copyright.
